Partner Program Terms & Conditions

This page explains our Terms and Conditions for the Partner Program. When you deposit credit to a Enhance Partner account you are agreeing to these terms.


Agreed Terms

Application of These Terms

These Supplementary Terms (“Partner Program Terms”) apply to the use of the Enhance Software (“Product”) provided by Enhance Hosting Automation Ltd (“we”, “us”, or “our”). They form an integral part of and operate in addition to our standard Terms and Conditions (the “Standard Terms”), found at https://enhance.com/terms and updated from time to time.

Precedence

In the event of any conflict or inconsistency between these Product Terms and the Standard Terms, these Product Terms shall prevail in relation to the Product.

Effective Date

These Product Terms take effect automatically upon making a payment (“Top Up Payment”) to add credits to your partner account at https://partners.enhance.com (“Partner Dashboard”).

Governing Law

These Product Terms, together with the Standard Terms, are governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Credits

Top up payment

Making a Top Up Payment will entitle you to Enhance Licence Credits at the rates displayed in the Partner Dashboard and updated from time to time.

Permitted Use

Credits may only be used to provision and renew Enhance cluster licences and pay-as-you-go support services provided by Enhance.

Non-Transferability and Non-Refundability

Enhance Server Credits (“Credits”) are non-exchangeable, non-refundable, and may not be redeemed for cash or monetary value. Credits cannot be transferred, assigned, or shared with any other organisation or third-party.

Validity Period

Credits are valid for a period of 5 years from the date of purchase. Upon expiration of this period, any remaining unused Credits will automatically be terminated and removed from the account without refund or compensation.

Payment Term

Credit Deduction

Credits shall be deducted from the account at the time of licence issuance and subsequently on each monthly anniversary of the licence creation date at the rates displayed in the partner dashboard https://partners.enhance.com, depending on the licence type and updated from time to time. Deductions shall continue unless the licence is actively cancelled or suspended by the account holder.

Credit Balance Requirements

The account holder is solely responsible for maintaining a sufficient credit balance to cover applicable charges. Credits may not be overdrawn under any circumstances. Suspension for Insufficient Credits In the event that the account does not contain sufficient credits at the time of renewal, the associated licence shall be automatically suspended without notice or grace period. Service access will be reinstated only upon restoration of a sufficient credit balance.

Partner Responsibilities

General Obligations

As an authorised Enhance Partner (“Partner”), you acknowledge and agree that you are solely responsible for the following:

(a) Server Provisioning – The provisioning, configuration, and ongoing management of all servers used in connection with the Enhance partner program.

(b) Customer Support – The provision of all support services and technical assistance required by your Customers, including but not limited to troubleshooting, maintenance, and issue resolution.

(c) Payment of Fees – The timely payment of all applicable Fees through the use of Enhance Server Credits, in accordance with the payment terms set forth by Enhance.

(d) Credit Availability – Ensuring sufficient Server Credits are maintained in your account at all times to prevent the account from becoming overdrawn or services from being interrupted.

Pay As You Go Partner Support

Billing and Charges

Pay as you go Partner Support is billed at a rate of 40 Server Credits per reported incident. Pay as you go support will be billed at the

Definition of Incident

An Incident is defined as an identifiable technical issue or support request raised by the Partner that requires investigation or action by Enhance. Enhance reserves the sole right to determine whether a reported ticket qualifies as a billable Incident.

Priority Handling

Pay-As-You-Go Partner Support requests are prioritised ahead of standard support tickets to facilitate faster response times for critical issues. However, Enhance does not guarantee any specific response or resolution time.

Support Availability

Support services are available during the hours published by Enhance and may be subject to change without prior notice.

Limitation of Liability

Enhance shall not be held liable for any loss, damage, data corruption, downtime, or other adverse consequences arising directly or indirectly from actions taken during the provision of support services or by any delay in handling a Support request. Server Access Support services may require Enhance personnel to access Partner servers via SSH or other remote methods. By requesting support, the Partner grants such access at their own risk. Enhance assumes no responsibility for any unintended system changes, disruptions, or data loss that may occur as a result of such access.

Termination

Partner-Initiated Termination

You may terminate your participation in the Enhance Partner Program at any time by providing written notice via email to partners@enhance.com. Upon termination, all unused Server Credits will be forfeited and shall not be refunded, transferred, or redeemed for cash or services.

Enhance-Initiated Termination

Enhance reserves the right to suspend or terminate your Partner Account immediately, without prior notice, if you are, or if Enhance reasonably suspects that you may be, engaging in fraudulent, criminal, or otherwise unlawful activity, or are in breach of these Terms and Conditions.
